Police have launched an investigation into allegations that Labour leader Sir Keir Starmer broke Covid-19 rules while drinking beer with colleagues during a coronavirus lockdown.
Durham Constabulary announced the probe on Friday as the opposition leader celebrated his party’s success in the local elections.
The force said it had held off on the announcement to avoid affecting the election.
Following the announcement, Sir Keir, who was celebrating in Carlisle, declined to answer questions about the investigation and left the hotel via a side entrance.
He has dismissed the claims as Tory "mudslinging".
Officers will now examine footage of Sir Keir drinking alcohol with Labour Party employees at a gathering during their campaign for the Hartlepool by-election in April 2021.
At the time of the alleged gathering, non-essential retail and outdoor venues including pub gardens were open but social distancing rules, which included a ban on indoor mixing between households, remained in place.
Details about the alleged event dubbed "beergate" came to light while Labour MPs were criticising Prime Minster Boris Johnson over the "partygate" scandal.
Sir Keir has dismissed the notion that drinking a beer at the event was comparable to the lockdown-breaking gatherings held at No 10 Downing Street, which resulted in fines for Prime Minister Boris Johnson, Chancellor Rishi Sunak and others.
“Earlier this year, Durham Constabulary carried out an assessment as to whether Covid-19 regulations had been breached at a gathering in Durham city on April 30, 2021," the police said in a statement on Friday.
“At that time, it was concluded that no offence had been established and therefore no further action would be taken.
“Following the receipt of significant new information over recent days, Durham Constabulary has reviewed that position and now, following the conclusion of the pre-election period, we can confirm that an investigation into potential breaches of Covid-19 regulations relating to this gathering is now being conducted.”
Police previously said they did not believe “an offence has been established in relation to the legislation and guidance in place at that time and will therefore take no further action in relation to this matter”.
A Labour Party spokesperson said no rules had been broken.
“We’re obviously happy to answer any questions there are and we remain clear that no rules were broken," it said.
Richard Holden, the Conservative MP for North West Durham, said police were doing “exactly the right thing” in investigating potential lockdown breaches involving Sir Keir.
“It’s vital that the man who wants to be prime minister is held to the same standard as the Prime Minister and everybody else," he said.
When it emerged Mr Johnson was under police investigation, Sir Keir had called it a "mark of shame" and demanded the prime minister resign.

Types of policy
Term life insurance: this is the cheapest and most-popular form of life cover. You pay a regular monthly premium for a pre-agreed period, typically anything between five and 25 years, or possibly longer. If you die within that time, the policy will pay a cash lump sum, which is typically tax-free even outside the UAE. If you die after the policy ends, you do not get anything in return. There is no cash-in value at any time. Once you stop paying premiums, cover stops.
Whole-of-life insurance: as its name suggests, this type of life cover is designed to run for the rest of your life. You pay regular monthly premiums and in return, get a guaranteed cash lump sum whenever you die. As a result, premiums are typically much higher than one term life insurance, although they do not usually increase with age. In some cases, you have to keep up premiums for as long as you live, although there may be a cut-off period, say, at age 80 but it can go as high as 95. There are penalties if you don’t last the course and you may get a lot less than you paid in.
Critical illness cover: this pays a cash lump sum if you suffer from a serious illness such as cancer, heart disease or stroke. Some policies cover as many as 50 different illnesses, although cancer triggers by far the most claims. The payout is designed to cover major financial responsibilities such as a mortgage or children’s education fees if you fall ill and are unable to work. It is cost effective to combine it with life insurance, with the policy paying out once if you either die or suffer a serious illness.
Income protection: this pays a replacement income if you fall ill and are unable to continue working. On the best policies, this will continue either until you recover, or reach retirement age. Unlike critical illness cover, policies will typically pay out for stress and musculoskeletal problems such as back trouble.

What the law says
Micro-retirement is not a recognised concept or employment status under Federal Decree Law No. 33 of 2021 on the Regulation of Labour Relations (as amended) (UAE Labour Law). As such, it reflects a voluntary work-life balance practice, rather than a recognised legal employment category, according to Dilini Loku, senior associate for law firm Gateley Middle East.
“Some companies may offer formal sabbatical policies or career break programmes; however, beyond such arrangements, there is no automatic right or statutory entitlement to extended breaks,” she explains.
“Any leave taken beyond statutory entitlements, such as annual leave, is typically regarded as unpaid leave in accordance with Article 33 of the UAE Labour Law. While employees may legally take unpaid leave, such requests are subject to the employer’s discretion and require approval.”
If an employee resigns to pursue micro-retirement, the employment contract is terminated, and the employer is under no legal obligation to rehire the employee in the future unless specific contractual agreements are in place (such as return-to-work arrangements), which are generally uncommon, Ms Loku adds.
