Q: I recently bought a property in Abu Dhabi that had a pre-existing lease, which I was told would end in September next year. The tenant says the lease agreement we have bought into grants them a further lease. I bought the property to live in. I am distressed by the situation as I cannot afford to pay rent and a mortgage. I have served an eviction notice for next year but the tenant is refusing to accept the eviction notice. What do I do?
A: As per article 18 of law no. 20 of 2006, which relates to rent and tenancy relationships in Abu Dhabi, if the ownership of a leased property moves to another owner the tenancy contract is still effective against the new owner. Under article 23 of the code, it also states that the tenant cannot be asked to leave the leased property, except for one of the following reasons:
If the owner of the property is to occupy the leased property himself for the purpose of housing, on the condition that the owner of the property is not suitable for housing in the municipal jurisdiction where the property lies. If you wish to enforce this exception you must give the tenant six months’ notice before the end of their tenancy contract. After they move out you must move in and live at the property for at least one year without interruption.

How Filipinos in the UAE invest
A recent survey of 10,000 Filipino expatriates in the UAE found that 82 per cent have plans to invest, primarily in property. This is significantly higher than the 2014 poll showing only two out of 10 Filipinos planned to invest.
Fifty-five percent said they plan to invest in property, according to the poll conducted by the New Perspective Media Group, organiser of the Philippine Property and Investment Exhibition. Acquiring a franchised business or starting up a small business was preferred by 25 per cent and 15 per cent said they will invest in mutual funds. The rest said they are keen to invest in insurance (3 per cent) and gold (2 per cent).
Of the 5,500 respondents who preferred property as their primary investment, 54 per cent said they plan to make the purchase within the next year. Manila was the top location, preferred by 53 per cent.

What the law says
Micro-retirement is not a recognised concept or employment status under Federal Decree Law No. 33 of 2021 on the Regulation of Labour Relations (as amended) (UAE Labour Law). As such, it reflects a voluntary work-life balance practice, rather than a recognised legal employment category, according to Dilini Loku, senior associate for law firm Gateley Middle East.
“Some companies may offer formal sabbatical policies or career break programmes; however, beyond such arrangements, there is no automatic right or statutory entitlement to extended breaks,” she explains.
“Any leave taken beyond statutory entitlements, such as annual leave, is typically regarded as unpaid leave in accordance with Article 33 of the UAE Labour Law. While employees may legally take unpaid leave, such requests are subject to the employer’s discretion and require approval.”
If an employee resigns to pursue micro-retirement, the employment contract is terminated, and the employer is under no legal obligation to rehire the employee in the future unless specific contractual agreements are in place (such as return-to-work arrangements), which are generally uncommon, Ms Loku adds.
