An unemployed labourer who was sentenced to 10 years in prison for stabbing a man 12 times has lost his appeal for a reduced sentence.
The 23-year-old Indian defendant told judges on Sunday that the deceased had attacked him first, throwing him out of their first floor accommodation and breaking his arm. He claimed he had then acted in self defence.
The deceased was found in a pool of blood on the morning of September 21 last year by fellow workers. Police were notified and visited the accommodation in Al Quoz Industrial Area 2, and saw the defendant running away.
A Pakistani driver, 32, said that he heard a noise at around 8am on the day of the incident and when he went to investigate, he saw the victim on the first floor carrying a broomstick while chasing the defendant.
"Then, when the two came to the ground floor, I saw blood on the victim's shirt," said the driver who called for an ambulance, but the man, also Indian, died on the way to Rashid Hospital, court records stated.
The accommodation's Cameroonian supervisor, 30, said that he also heard noise and on inspection found workers looking down at the ground floor saying that a colleague had been stabbed.
"Someone was screaming. I rushed to the source of the screams and saw the victim lying on his back and bleeding heavily," said the supervisor, who managed to restrain the suspect until police arrived.
He said that the deceased was shaking his head and moving his eyes, but couldn't speak.
According to court records, the defendant tried to climb the fence to run away but the supervisor chased him, then police officers managed to take him into custody.
"I also found the knife he used to stab the victim. I did not touch it, just covered it with plastic until police arrived," the supervisor said.
He pointed out that the defendant had cancelled his visa with the company and was supposed to fly back to his home country the same day the murder took place.
The court records did not elaborate on the reasons for the stabbing, which included 12 stab wounds in the face, neck, chest and back.
"The nature of the stab wounds indicate that they were intended to kill," the prosecutor's report said.
Dubai Criminal Court sentenced the defendant to 10 years in prison, which he will now serve after losing his appeal for a reduced sentence. He will be deported after serving his term.
