A man who was cleared of distributing drugs will now spend five years in prison after his acquittal was overturned by a higher court.
Police were tipped off about the Indian man’s activities by two of his customers in May last year.
Police had arrested the two customers who, during questioning, told them the accused gave them hashish, but they did not pay him.
"He gave me drugs two times for free," said one of the customers.
The pair were referred to the Court of Misdemeanours to face a charge of consuming drugs.
The Indian dealer was arrested on June 15 on charges of distributing drugs.
During police and prosecution questioning, the accused denied possessing or distributing drugs. He also denied facilitating drug consumption.
At Dubai Criminal Court, in July last year, the man was charged with facilitating drug consumption, which he denied. The court cleared him of the charge.
Prosecutors appealed the verdict and Dubai Court of Appeal sentenced the man to five years in prison followed by deportation. He was also ordered to pay a Dh20,000 fine.

What the law says
Micro-retirement is not a recognised concept or employment status under Federal Decree Law No. 33 of 2021 on the Regulation of Labour Relations (as amended) (UAE Labour Law). As such, it reflects a voluntary work-life balance practice, rather than a recognised legal employment category, according to Dilini Loku, senior associate for law firm Gateley Middle East.
“Some companies may offer formal sabbatical policies or career break programmes; however, beyond such arrangements, there is no automatic right or statutory entitlement to extended breaks,” she explains.
“Any leave taken beyond statutory entitlements, such as annual leave, is typically regarded as unpaid leave in accordance with Article 33 of the UAE Labour Law. While employees may legally take unpaid leave, such requests are subject to the employer’s discretion and require approval.”
If an employee resigns to pursue micro-retirement, the employment contract is terminated, and the employer is under no legal obligation to rehire the employee in the future unless specific contractual agreements are in place (such as return-to-work arrangements), which are generally uncommon, Ms Loku adds.

UN Panel of Experts found regime secretly sold a fifth of the country's gold reserves.
The panel’s 2017 report followed a trail to West Africa where large sums of cash and gold were hidden by Abdullah Al Senussi, Qaddafi’s former intelligence chief, in 2011.
