Man who assaulted woman during 'drunken prank' in Dubai gets six months

DUBAI // A man who sexually assaulted a female student during a drunken "prank" has been sentenced to six months in prison.

RM, 30, from India, poured water on the student's door, before pushing his way in and attacking her when she came to investigate. As she was screaming he threw her on the bed and fondled her, threatening to kill her as he did so. He then left the room.

The student, who was staying in a shared villa, reported the attack to her father and police were called.

Officer JA, 50, responded to the call on December 22 last year. When he arrived he saw the girl crying and bleeding from her mouth.

"She told me the man threatened to kill her if she called police," he said.

The man was found guilty on charges of issuing threats, sexual assault, physical assault, trespassing and illegally consuming alcohol. In addition to the six-month jail term he was fined Dh2,000 on the alcohol charge.

During his trial the man had claimed the student invited him into her room. "I was pouring water as a prank your honour," he said.

He will be deported after completing his jail term.

Micro-retirement is not a recognised concept or employment status under Federal Decree Law No. 33 of 2021 on the Regulation of Labour Relations (as amended) (UAE Labour Law). As such, it reflects a voluntary work-life balance practice, rather than a recognised legal employment category, according to Dilini Loku, senior associate for law firm Gateley Middle East.

“Some companies may offer formal sabbatical policies or career break programmes; however, beyond such arrangements, there is no automatic right or statutory entitlement to extended breaks,” she explains.

“Any leave taken beyond statutory entitlements, such as annual leave, is typically regarded as unpaid leave in accordance with Article 33 of the UAE Labour Law. While employees may legally take unpaid leave, such requests are subject to the employer’s discretion and require approval.”

If an employee resigns to pursue micro-retirement, the employment contract is terminated, and the employer is under no legal obligation to rehire the employee in the future unless specific contractual agreements are in place (such as return-to-work arrangements), which are generally uncommon, Ms Loku adds.
